LIABILITY WAIVER, ASSUMPTION OF RISK

ACKNOWLEDGMENT OF RISK

I understand that participation in fitness, strength and conditioning, sports performance, personal training, semi-private training, group training, boot camps, mobility work, athletic development, and other physical activities offered at Jus 2 Showoff Performance involves inherent risks.

These risks may include, but are not limited to:

  • Muscle strains, sprains, or tears

  • Joint or ligament injuries

  • Falls or collisions

  • Equipment-related injuries

  • Dizziness, fainting, or shortness of breath

  • Cardiovascular complications

  • Aggravation of existing injuries or medical conditions

  • Serious injury, disability, or, in rare circumstances, death

I understand that these risks may occur even when proper instruction, supervision, and reasonable safety precautions are provided.

I voluntarily choose to participate and accept the risks associated with physical activity and use of the facility.

HEALTH RESPONSIBILITY

I confirm that I am physically capable of participating in exercise and training activities.

I understand that it is my responsibility to disclose any injuries, medical conditions, physical limitations, medications, or other health concerns that may affect my ability to exercise safely.

I agree to stop exercising and immediately notify a trainer or staff member if I experience pain, dizziness, unusual shortness of breath, chest discomfort, or other concerning symptoms.

I understand that Jus 2 Showoff Performance and its trainers do not provide medical diagnosis or medical treatment.

I am responsible for obtaining medical clearance from a qualified healthcare provider when appropriate.

FACILITY AND EQUIPMENT USE

I agree to:

  • Follow instructions provided by Jus 2 Showoff Performance trainers and staff

  • Use equipment only for its intended purpose

  • Use equipment in a safe and responsible manner

  • Notify staff of damaged or unsafe equipment

  • Follow all posted and communicated facility rules

  • Avoid behavior that may create an unsafe environment for myself or others

I understand that failure to follow facility rules or staff instructions may result in removal from a training session or termination of facility privileges.

RELEASE OF LIABILITY

To the fullest extent permitted by California law, I voluntarily assume the ordinary risks associated with participating in physical training activities and using the Jus 2 Showoff Performance facility and equipment.

I release and hold harmless Jus 2 Showoff Performance, its owners, employees, coaches, trainers, agents, contractors, and representatives from claims arising from the ordinary inherent risks of participation in fitness and training activities, except where liability cannot legally be waived.

This release is not intended to waive any rights that cannot legally be waived under California law.

PERSONAL PROPERTY

I understand that Jus 2 Showoff Performance is not responsible for lost, stolen, or damaged personal property brought into or left at the facility.

I am responsible for securing my personal belongings.

EMERGENCY MEDICAL AUTHORIZATION

If I experience a medical emergency while participating in activities at Jus 2 Showoff Performance and I am unable to communicate my wishes, I authorize staff to contact emergency medical services when reasonably necessary.

I understand that I am responsible for any medical or emergency transportation costs associated with my care.

TRAINING WITH AUTHORIZED COACHES

I understand that services at Jus 2 Showoff Performance may be provided by the owner, employees, independent trainers, contractors, or other authorized fitness professionals.

I agree that this waiver applies to my participation in activities conducted by authorized Jus 2 Showoff Performance trainers and professionals while using the facility or participating in Jus 2 Showoff Performance activities.

PHOTO AND VIDEO RELEASE

I understand that photographs, video recordings, or other media may be captured during training sessions, classes, events, workouts, or other activities at Jus 2 Showoff Performance.

I grant Jus 2 Showoff Performance permission to use photographs or video recordings that include my image, likeness, or participation for legitimate business and promotional purposes, including:

  • Social media

  • Website content

  • Advertising

  • Marketing materials

  • Promotional videos

  • Educational content

  • Facility-related media

I understand that I will not receive compensation for the use of this media.

I understand that participation in training is not dependent upon agreeing to promotional media use where applicable.

PARTICIPANT RESPONSIBILITY

I agree to communicate openly with my trainer regarding:

  • Current injuries

  • Previous injuries

  • Pain or discomfort

  • Physical limitations

  • Changes in my health

  • Any condition that may affect safe participation

I understand that withholding relevant health or injury information may increase my risk of injury.

ACKNOWLEDGMENT

I confirm that:

  • I have read this waiver in full

  • I understand the risks associated with physical training

  • I have had the opportunity to ask questions before signing

  • I am voluntarily participating

  • I understand that this document affects certain legal rights

  • I agree to comply with the rules and safety requirements of Jus 2 Showoff Performance

  • I understand and agree to the photo and video release described above

I understand that this waiver remains effective for my participation at Jus 2 Showoff Performance unless replaced by a newer written agreement.

PARTICIPANTS UNDER 18

For participants under the age of 18, a parent or legal guardian must provide consent for participation.

The parent or legal guardian acknowledges the risks described in this waiver and gives permission for the minor to participate in activities at Jus 2 Showoff Performance.

The parent or legal guardian also acknowledges and agrees to the media release provisions above unless otherwise stated in writing.
